Settling a trust at the wrong time, or without a relationship property agreement, can put ‘safe’ pre-relationship assets at risk on separation. Including a spouse or partner as a discretionary beneficiary of an existing trust, even for very good reasons, can put the entire trust at risk on separation – even where there aren’t any children of the relationship, and the relationship was relatively short-lived. Making changes to a trust for orthodox tax reasons can cost the trust those savings hundreds of times over.
