The Australian Taxation Office recently released draft publications. These assert a broad interpretation and application of somewhat dormant taxation provisions to foreign trust distributions, gifts and loans to (and the use of trust property) by Australian beneficiaries of those foreign trusts. The outcome can be less than palatable, especially given the ATO’s sights are set on not only discretionary trusts, but also deceased estates.
This session will provide a contextual outline of:
- The taxation of trust distributions in the hands of Australian beneficiaries
- The importance of the source of those distributions
- The Australian taxation of foreign trust distributions given the ATO’s position
- Strategies that may be available to mitigate the taxation of foreign trust distributions in the hands of Australian resident beneficiaries.
